On July 12, 2012, USEPA issued a final rule for Step 3 of the Tailoring Rule which retains the greenhouse gas (GHG) permitting thresholds that were established in Steps 1 and 2 of the GHG Tailoring Rule; i.e., 100 tpy CO2e for Title 5 permits and new source construction permits and 75 tpy CO2e for “major modification” construction permits.
